The processes mediating dynamic and flexible responding to rapidly changing task-environments are not well understood. In the present research we employ a Stroop procedure to clarify the contribution of context-sensitive control processes to online performance. In prior work Stroop interference varied as a function of probe location context, with larger Stroop interference occurring for contexts associated with a high proportion of congruent items [Crump, M. J., Gong, Z., & Milliken, B. . The context-specific proportion congruent stroop effect: location as a (...) contextual cue. Psychonomic Bulletin & Review, 13, 316–321.] Here, we demonstrate that this effect does not depend on awareness of the context manipulation, but that it can depend on attention to the predictive context dimension, and on the relative salience of the target and predictive context dimensions. We deal with situations incongruent with our automatic response tendencies much better right after having done so on a previous trial than after having reacted to a congruent trial. The nature of the mechanisms responsible for these sequential congruency effects is currently a hot topic of debate. According to the conflict monitoring model these effects depend on the adjustment of control triggered by the detection of conflict on the preceding situation. We tested whether these conflict monitoring processes can operate implicitly (...) in an implicit learning procedure, modulating the expression of knowledge of which participants are not aware. We reanalyze recently published data, and present an experiment with a probabilistic sequence learning procedure, both showing consistent effects of implicit sequence learning. Despite being implicit, the expression of learning was reduced or completely eliminated right after trials incongruent with the learned sequence, thus showing that sequential congruency effects can be obtained even when the source of congruency itself remains implicit. Cuando la profesora y directora de la revista Problema, Sandra Gómora Juárez, nos propuso a la profesora Marina Gascón Abellán y a mí llevar a cabo una discusión acerca de las teorías y doctrinas del precedente en nuestro contexto, no me pude sentir más contento. Al indudable y reconocido prestigio de la revista Problema se sumó la posibilidad de volver a trabajar con la profesora Marina Gascón y hacerlo por primera vez con Sandra Gómora. Además, surgió la oportunidad de volver (...) a discutir con viejos amigos —como Flavia Carbonell, Fabio Pulido, Silvia Zorzetto— sobre cuestiones relativas al precedente, y poder contrastar opiniones con otros nuevos, como Rodrigo Camarena. En esta ocasión, me corresponde comentar, en particular, los trabajos del profesor Fabio Pulido Ortiz y de la profesora Silvia Zorzetto. Ambos trabajos son de una indudable calidad. El del profesor Pulido Ortiz, de la Universidad de La Sabana de Colombia, es un trabajo de finura y sutileza analítica que entra a discutir, al calor de la teoría del precedente, algunos problemas fundamentales de la teoría del derecho. La profesora Silvia Zorzetto, de la Università Statale di Milano, ha llevado a cabo un reconocimiento analítico y metalingüístico de la práctica de los precedentes en Italia, con especial atención a le Sezioni Unite Civili della Corte di Cassazione italiana, de incalculable valor. Ello no sólo por el valor que pueda tener para el estudio de la cultura jurídica (interna) italiana, sino porque su análisis puede ser, al menos en parte, generalizado para dar cuenta de cómo son usados los precedentes en los ordenamientos de civil law. El objetivo del trabajo es mostrar que la teoría tradicional sobre los conceptos dogmáticos es incapaz de dar cuenta de todas las funciones que tales conceptos cumplen en el discurso de los estudiosos del derecho positivo. Para resolver el problema, propongo distinguir, desde un punto de vista realista, entre dos tipos de conceptos dogmáticos: los legales y los científicos. Procederé mediante cinco pasos. En primer lugar, aclararé a qué me estoy refiriendo con conceptos dogmáticos. En segundo lugar, propondré cómo creo (...) que debe ser una teoría realista de los conceptos dogmáticos. En tercer lugar, presentaré la distinción entre los conceptos dogmáticos legales y los conceptos dogmáticos científicos. En cuarto lugar, señalaré cuáles son las funciones de las que no puede dar cuenta la teoría tradicional de los conceptos dogmáticos como conceptos legales. Finalizaré con unas breves conclusiones. El objetivo del presente trabajo es analizar críticamente alguno de los conceptos de soft law más difundidos en la literatura como paso previo necesario para formular una definición que sirva para mejorar nuestra comprensión sobre el soft law. Para ello, en primer lugar, afirmaré que los intentos de definición extensional de la expresión “soft law” tienen el problema de, bien ser inmanejablemente largas, bien terminar convirtiéndose en definiciones intensionales vagas. A continuación, presentaré dos definiciones de soft law ampliamente compartidas por (...) la literatura (Snyder y Senden). Posteriormente, dividiré dicha definición para su análisis crítico en tres partes: el soft law es un conjunto de reglas de conducta; el soft law no es jurídicamente vinculante; y el soft law puede producir efectos prácticos y jurídicos (estos últimos, solo indirectos). Concluiré sosteniendo que las propiedades identificadas por estas definiciones no sirven para caracterizar adecuadamente el soft law. (shrink)

Seguimos como camino el método triangular propuesto por Elio Sgreccia: ver los datos científicos para realizar un análisis antropológico y una valoración ética que oriente el actuar concreto.La naprotecnología, como ciencia médica, constituye un abordaje médico y científico que busca resolver los (...) trastornos reproductivos y ginecológicos del varón y de la mujer, identificando las principales causas que afectan a la verdadera salud reproductiva. A partir de este diagnóstico, busca corregir las posibles alteraciones y restaurar la salud y fertilidad. Este modo de afrontar la infertilidad/esterilidad se ilustra con varios casos clínicos y los resultados obtenidos en España durante los años 2015 a 2021. A continuación, realizamos un análisis antropológico del modo de afrontar la infertilidad, analizando el sujeto que la padece: ¿Quién es el ser humano? ¿Cómo es su sexualidad? ¿En qué entorno se realiza primordialmente la procreación? Con esta base esbozamos un juicio ético ante este modo de afrontar los problemas de infertilidad/esterilidad. (shrink)

Para Ferrajoli son derechos fundamentales todos aquellos derechos subjetivos que corresponden universalmente a todos los seres humanos en cuanto dotados del status de ciudadanos o personas con capacidad de obrar, entendiendo por derecho subjetivo (...) cualquier expectativa positiva o negativa adscrita a un sujeto por una norma jurídica positiva. Los derechos fundamentales son universales y ese universalismo puede relacionarse, según Ferrajoli, con el multiculturalismo. El artículo ofrece un panorama del precedente en el Civil Law con el objetivo de distinguir los problemas que pueden presentarse en los sistemas jurídicos que tienen una práctica formal o institucionalizada de precedente, de aquellos en los que no la hay. Se identificó que se introdujo el precedente como una forma de responder a las crecientes demandas de administración de justicia en la materia y delimitar la discrecionalidad del operador jurídico. Por tanto, la tesis de fondo de este trabajo (...) es que, en la operación regular de los sistemas jurídicos del Civil Law, tanto los tribunales constitucionales y la jurisdicción en general identificaron la necesidad práctica de dotar de contornos a los derechos humanos —en tanto disposiciones jurídicas a concretar jurisdiccionalmente—. The aim of the present research was to assess elite student-athletes’ perception of the dual career during the lockdown caused by the coronavirus disease 2019 pandemic, compared with a group of elite student-athletes who could develop their dual career under normal conditions. A total of 150 elite athletes who were also undergraduate or postgraduate students self-completed the “Perceptions of dual career student-athletes ” questionnaire. From them, 78 did it during the mandatory lockdown period due to the state of emergency caused (...) by COVID-19 and 72 completed it in the previous year to Rio 2016 Olympic Games. The COVID-19 group was found to spend a significantly higher number of hours per week studying, while no significant differences were observed between groups in any training time variable. Student-athletes of the COVID-19 group showed better perception of whether their sport career could help them cope with their academic career and better general perception of remote learning and the use of tasks and videoconferencing as learning support tools. A lower percentage of athletes of the COVID-19 group than of the control group wished to continue with their sport career once they finished their studies. To conclude, student-athletes of the COVID-19 group show adaptations with regard to the organization of their studies and the importance they give to them and to the services provided by dual-career programs, compared with student-athletes from an ordinary pre-Olympic year. This study aimed to investigate the student-athletes' capability to face the academic, sport, and social challenges during the coronavirus disease 2019 (COVID-19) lockdown and to disclose novel aspects of dual careers. A 32-item online survey encompassing demographic characteristics, sport and university engagement, support and dual-career benefits, physical activity, sitting time, and the time deemed necessary to recover the previous level of performance was developed. Four hundred sixty-seven student-athletes (males: 57%, females: 43%) from 11 countries, competing in 49 different sports (individual: (...) 63.4%, team: 36.6%) at regional (17.5%), national (43.3%), and international (39.2%) levels, and enrolled at high school (21.9%) and university (78.1%) levels completed the survey. During the lockdown, the respondents decreased the time dedicated to sport and academics, although they maintained an active lifestyle. Student-athletes from countries under severe contagion were more likely to train at home, dedicate to academics, and receive support from the coach but less likely receive support from their teachers. With respect to their team sport counterparts, athletes competing in individual sports trained more and were more likely to receive support from their coaches. International athletes showed the highest training time and support from their coaches and as student-athletes. High school students received more support from their coaches and teachers, whereas university students were more likely considering dual careers useful to cope with the COVID-19 pandemic. This study substantiates the relevant role of competitive sports participation in the maintenance of active lifestyles, with student-athletes considering home training and e-learning valuable resources during the lockdown. Furthermore, their sport and academic commitments helped student-athletes cope with the emergency of the COVID-19 pandemic. (shrink)

Se analiza, en este estudio, la sintáctica, la semántica y la pragmática del conflicto en una muestra de 359 profesores de enseñanza no universitaria en España. Se establece la vinculación entre las dimensiones de la sintáctica del conflicto y los modos o estrategias de afrontamiento del conflicto propuestos por Kreidler, 1984. Los resultados apuntan hacia una visión negativista de la realidad del conflicto como fruto de la cultura, aunque con ciertos indicios de positividad en cuanto a la pragmática del conflicto.

The dual career allows elite athletes to attain their maximum competitive and academic performance, but the COVID-19 pandemic hindered their development and changed their perception of the importance given to the sporting and educational environment. For this reason, the aim of the present study was to determine the differences in the motivations and perceived barriers, the importance given to academic qualifications, and the perception of the dual career from a multifactorial perspective, of elite athletes according to sex, type of sport (...) practiced, job performance, time of sports career, type of athlete, and type of scholarship received. A total of 100 student-athletes participated in the research study by completing the “Perceptions of dual career student-athletes” questionnaire. The results showed that athletes from individual modalities and those who did not receive any scholarships described more barriers. In addition, women studied more because they enjoyed it ; athletes from individual modalities studied to work later ; athletes who do not work perceived a greater influence between study and sports performance ; at the beginning and at the best stage of their sports career, a greater influence of academics on performance was perceived ; and athletes who considered themselves professionals, and athletes who did not receive any scholarships, reported that the conciliation between sports and academic life was difficult. The results obtained point to the importance of dual career scholarships for student-athletes, as well as the need for the programs implemented for these athletes to consider sex, sport modality or type of scholarship granted. In this paper, building on the author's prior work [12] [13] [14], we show that the relative complexity of first-order theories in Keisler's sense is reflected in the relative graph-theoretic complexity of sequences of hypergraphs associated to formulas of the theory. After reviewing prior work on Keisler's order, we present the new construction in the context of ultrapowers, give various applications to the open question of the unstable classification, and investigate the interaction between theories and regularizing sets. We show that there is a minimum unstable theory, a minimum TP 2 theory, and that maximality is implied by the density of certain graph edges (between components arising from Szemerédi-regular decompositions) remaining bounded away from 0, 1. We also introduce and discuss flexible ultrafilters, a relevant class of regular ultrafilters which reflect the sensitivity of certain unstable (non low) theories to the sizes of regularizing sets, and prove that any ultrafilter which saturates the minimal TP 2 theory is flexible. Bilim felsefesinin en temel problemlerinden biri olan sınırlandırma problemi belirli bir ölçüt vasıtası ile bilimi, bilimsel olmayan ya da sahte/sözde bilim olan etkinliklerden ayırt edip edemeyeceğimizi konu edinmektedir. Literatüre baktığımızda felsefeciler –özellikle bilim felsefecileri– bilimin doğasını karakterize etme girişiminde bulunurken bilim dilinin mantıksal yapısına ya da bilimin tarihsel süreçlerine odaklanarak, bilimi bilimsel olmayan ya da sahte-bilim olan etkinliklerden ayırt etmişlerdir. Bu çalışma ise farklı bir yaklaşım benimseyerek sınırlandırma problemine, felsefecilerin değil, bilim insanlarının perspektifi ile bakmayı amaçlamaktadır. Bu sebeple alanında deneyimli (...) ve çeşitli bilim dallarında profesör olan otuz bilim insanı ile niteliksel araştırma yöntemlerinden biri olan yapılandırılmış görüşme tekniği uygulanmıştır. Shah O.P.Recent trends in Catholic theology emphasize the category of "mystery." But "problems," which can seem distinct from and even opposed to mysteries, have a constitutive role in the work of theology as well. If the object of faith is God, and if theology's goal is typically defined as "faith seeking understanding," then the object of theology must include the (...) seeking's problematical quotient. At the very least, problems condition the faith-and-reason labor of theological enquiry. This essay claims that problems philosophically orient and index the theological articulation of mysteries—not the mysteries themselves—particularly in a modern key, and that they require explicit attention in theological methodology and pedagogy.First, I explain my concern with the "return to mystery" in conciliar-era Catholic theology. This explanation entails, second, describing the special attention to "problems" in neo-Kantianism, which bequeaths the tension between the empirical world and transcendental freedom to modern theology. These two historiographical matters in methodology set up the tension between problems and mysteries for Catholic thinking. Third, I briefly return to Aristotle's thoughts on the matter, which are a lodestone for the tradition. Fourth, I evaluate the positions of Jacques Maritain and Gabriel Marcel, the most important conciliar-era thinkers who thematized the relationship between problems and mysteries. My treatment will show how both ontological (Maritain) and existential (Marcel) dynamics of mystery are necessarily linked to metaphysical and spiritual problems. The [End Page 1265] critical ascertaining of theological mystery formally requires orientation via philosophical problems.My concern here is fundamental, ecclesial, and professional, interested that those who serve the Church through theological writing and teaching do so in a recognizably common or compatible manner, and in a way that can meaningfully stimulate theological interest. If the teaching of theology would invite students to embark upon the via inventionis and not merely yield to the via doctrinae, there must be fundamental advertence to ontological and existential problems as the theologically constitutive point of departure.1 Theologians do well to think in correlative terms of problems and mysteries. As a fifth and final point, then, I suggest that the quintessential starting point for (fundamental) theology today is the problem and mystery of the human person.Historical Context 1: The Return to MysteryContemporary Church life and theology have witnessed a "return to mystery."2 "Mystery" refers to some range or dynamic of reality that is essentially inaccessible apart from some feature of religious or spiritual practice. Christian reference to "mystery" or "mysteries" etymologically intimates that there are realities of which we cannot and/or ought not to speak, even as these mysteries have in some way been disclosed.3 Mysteries, therefore, are tensional in that they indicate at once contact and transcendence, knowledge and nescience. Christians and others communicate in religious mysteries through liturgical exercise and creedal confession, as well as through personal prayer and even existential trial. They are mediations of what is categorically transcendent, of what constitutively eludes or escapes [End Page 1266] the categories of our objectifying consciousness. Accordingly, the mysterious regards the inarticulable.That the substance of religious mysteries is real or true cannot be proven beyond all question, not according to commonly accessible human criteria of justification. For Christians, the gift of faith provides the convincing motive to believe in the reality of Christian mysteries through a kind of thinking with felt decision. Granting this claim, the work of theology is to reflect upon the mysteries of faith and develop expressible knowledge. Theology articulates (the) faith, extrapolating upon the reasons that the heart has for its belief. To do this work, theology trades upon fixed standards of confessional speech, liturgical practice, and perhaps also moral action, which provide lexical cogency and communicable intelligibility.The late nineteenth century witnessed attacks upon theology's claims to objectively or universally valid expression, owing especially to challenges from both epistemology and historiography.4 The surge of post-Enlightenment liberalism was surely catalytic as well. Bu ziyareti takiben yapılan analizler Çin’in, Körfez açılımını ABD’nin bölgesel hegemonyasını zayıflatmaya yönelik bir girişim olarak değerlendirmektedirler. Aynı ziyaret sırasında Pekin ve Riyad yönetimleri arasında imzalanan kapsamlı anlaşmalar ise ABD’nin Körfezdeki uzun erimli güvenlik partneri Suudi Arabistan’a ilişkin “eksen kayması” tartışmalarını başlattı. Bu çalışma güncelliğini koruyan iki tartışmanın kapsamlı bir muhakemesini yapmayı (...) hedeflemektedir. _Zettel, _ an en face bilingual edition, collects fragments from Wittgenstein's work between 1929 and 1948 on issues of the mind, mathematics, and language.

We study the minimal enumeration degree problem in models of fragments of Peano arithmetic () and prove the following results: in any model M of Σ2 induction, there is a minimal enumeration degree if and only if M is a nonstandard model. Furthermore, any cut in such a model has minimal e-degree. By contrast, this phenomenon fails in the absence of Σ2 induction. In fact, whether every Σ2 cut has minimal e-degree is independent of the Σ2 bounding principle.
